Terms of Service

These terms apply to all orders placed with Apex Digital Agency (“Apex”, “we”, “us”). By placing an order you agree to them, together with our Privacy Policy and Refund Policy.

1. The service

We create cinematic vertical video ads and, in larger packages, ad copy and a custom offer page (a product store on a private link) from the photos and information you provide. The packages are:

• Single Hook ($49): one product or business and one video ad.
• Conversion Funnel ($200): one product or business, two video ads with different creative angles, an ad copy pack, and a custom offer page.
• Multi-Product Scaler ($500): up to two products, four video ads, ad copy, and a custom offer page.

An optional Express 24-hour delivery add-on is available at checkout. The contents of each package are as described on our website at the time you order.

2. Ordering and payment

You place an order by completing our order form and paying through our payment provider, Lemon Squeezy, which acts as the merchant of record and handles payment, taxes and receipts. Prices are shown in US dollars unless stated otherwise. Production starts after payment is confirmed and we have received the information and photos we need.

3. Delivery

Deliverables are provided as downloadable files in a private folder and, where included, as a link to your offer page. Standard orders are delivered as soon as production is complete. Express orders are prioritised for delivery within 24 hours of confirmed payment and complete order details. Delays caused by missing or unclear information, or by events outside our control, may extend delivery times.

4. What you provide

• You confirm that you own, or have permission to use, every photo, name, logo, text and other material you send us.
• Clear, sharp, well-lit photos give the best results. The quality of the deliverables depends partly on the quality of what you send.
• You must not send unlawful, infringing, deceptive, hateful or adult content, or content about products that are illegal or restricted for advertising.

5. Your content and platform rules

Your finished videos are edited with a voiceover, music and titles. Small details such as shapes, textures or lettering can vary between shots. You are responsible for following the rules of the platforms where you publish.

6. Your rights to the deliverables

After payment, you receive a non-exclusive, worldwide, perpetual licence to use the delivered videos, copy and offer page content to advertise and sell your own products and services. You may not resell the files as stock content or present them as your own standalone creative work for other businesses. We keep the right to show your delivered work in our portfolio and on our website. If you do not want this, tell us in writing and we will not display it. Underlying tools, templates and methods remain ours or our providers’.

7. Offer pages

If your package includes an offer page, we host it on a private link as part of the package. We may update, move or remove it with reasonable notice. The offer, prices and availability shown on your page are yours; you are responsible for fulfilling orders you receive through it, including the WhatsApp number, email or link you provide.

8. No guarantee of results

We aim to deliver high-quality work, but we cannot guarantee any particular views, clicks, sales or return on your advertising spend.

9. Changes and revisions

Packages include the deliverables listed on our website. Additional versions, changes or extra videos are not included unless we agree to them in writing, and may carry an extra fee.

10. Refunds

Because our service is digital and production begins right after payment, refunds are limited as described in our Refund Policy.

11. Limitation of liability

To the fullest extent permitted by law, Apex is not liable for indirect or consequential losses, including lost profits, lost sales or loss of data. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these terms limits rights that cannot be limited under the law that applies to you as a consumer.

12. Suspension

We may decline or stop an order that breaches these terms or that we reasonably believe is unlawful or harmful. If we do so before delivering, we will refund what you paid for the undelivered work.

13. Changes to these terms

We may update these terms. The version in force when you place your order applies to that order.
